Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and ClarityTV Media Inc. (“ClarityTV,” “we,” “us,” or “our”) and govern your access to and use of the ClarityTV website, apps and services (collectively, the “Service”). Please read them carefully.

1. Acceptance of Terms

By creating an account, purchasing a plan or using the Service, you confirm that you are at least the age of majority in your province and that you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

ClarityTV provides a licensed streaming service that lets Canadian customers watch live channels and on-demand content on compatible devices over their own broadband connection. All content is delivered from properly licensed sources; you are responsible for supplying compatible hardware and a suitable internet connection.

3. Accounts

You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential and for all activity that occurs under your account. Notify us immediately at support@claritytv.ca if you suspect unauthorized use.

4. Plans, Payment & No Auto-Renewal

• All ClarityTV plans are one-time payments in Canadian dollars (CAD) unless otherwise stated at checkout, on the plan length you select (3, 6, 12 or 24 months).
• Nothing renews automatically. Your payment method is never stored for future charges. When your plan expires, access simply ends unless you choose to manually purchase a new plan.
• Accepted payment methods include Visa, Mastercard, American Express and Interac e-Transfer, all processed over encrypted, PCI-compliant channels.
• Prices, features and available plans may change; changes apply only to future purchases and do not affect the term of a plan you have already paid for.
• Because every payment is one-time, there is no cancellation to perform — access ends automatically on the expiry date of your plan.
• Applicable federal (GST/HST) and provincial (PST/QST) taxes will be added where required.

5. Refunds

New customers are protected by our 7-day money-back guarantee on their one-time payment. Full details, eligibility and the request process are set out in our Refund Policy, which is incorporated into these Terms by reference.

6. Acceptable Use

You agree not to:

• Share, resell, sublicense or redistribute your account credentials or the Service to third parties;
• Use the Service in any way that violates Canadian law or the laws of your province;
• Attempt to reverse-engineer, decompile, scrape, or interfere with the Service or its underlying infrastructure;
• Use the Service in a commercial venue (bar, restaurant, hotel, etc.) unless you have entered a separate commercial agreement with us;
• Circumvent security features, content-protection systems or geo-restrictions.

We may suspend or terminate accounts that violate this section, with or without notice, and without refund where the violation is material.

7. Intellectual Property

The ClarityTV brand, website design, app software and all associated trademarks are our property or that of our licensors. All streamed content is owned by the respective rights holders. You receive a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial purposes only.

8. Third-Party Devices & Networks

ClarityTV is delivered over your internet connection and viewed on third-party hardware. We are not responsible for issues caused by your ISP, WiFi network, router, VPN, or device. Recommended internet speed and setup guidance are available in our FAQ and blog.

9. Disclaimers

The Service is provided “as is” and “as available.” While we work hard to deliver 99.9% uptime, we do not guarantee that the Service will always be uninterrupted, error-free or free of security vulnerabilities. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, ClarityTV Media Inc. and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to the Service. Our total aggregate liability for any claim arising out of these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless ClarityTV Media Inc. from any claim, loss or damage (including legal fees) arising from your breach of these Terms or your misuse of the Service.

12. Termination

You do not need to cancel — every ClarityTV plan is a one-time payment that expires on its scheduled end date and does not renew. You may also request that we delete your account by emailing support@claritytv.ca. We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service.

13. Governing Law

These Terms are governed by the laws of Canada and the province in which ClarityTV Media Inc. is registered, without regard to conflict-of-law rules. You submit to the exclusive jurisdiction of the courts of Canada for any dispute arising from these Terms or the Service.

14. Changes to These Terms

We may update these Terms from time to time. When changes are material, we will notify active customers by email and post the updated document here with a new “Last updated” date. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
